Terms of Service

Please read these terms carefully before using our services.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and The Parenthood Project USA ("Company," "we," "us," or "our"). By accessing our website, booking our services, or engaging with us in any capacity, you agree to be bound by these Terms.

If you are booking services on behalf of another person (such as a partner or family member), you represent that you have the authority to bind that person to these Terms.

If you do not agree to these Terms, please do not use our website or services.

2. Description of Services

The Parenthood Project USA provides a range of support services for expectant and new parents, including but not limited to:

2.1 Birth Doula Services

  • Prenatal consultations and birth preparation sessions
  • Development of birth preferences and advocacy planning
  • Continuous labor and delivery support
  • Physical comfort measures, emotional support, and partner guidance
  • Immediate postpartum support (typically 1-2 hours after birth)
  • Postpartum follow-up visit(s)

2.2 Postpartum Support Services

  • Daytime postpartum doula support
  • Overnight postpartum care
  • Newborn care education and support
  • Infant feeding support (breastfeeding, bottle-feeding, combination feeding)
  • Light household assistance and meal preparation
  • Emotional support and resource referrals
  • Sibling adjustment support

2.3 Infant Sleep Consulting

  • Comprehensive sleep assessments
  • Customized sleep plans tailored to your family's values and lifestyle
  • One-on-one coaching sessions (virtual and in-person)
  • Text, email, and voice message support
  • Follow-up consultations and plan adjustments

2.4 Childbirth Education

  • Private and group childbirth preparation courses
  • Self-paced online educational programs
  • Specialized workshops (hypnobirthing, newborn care, etc.)

2.5 Additional Services

  • Placenta encapsulation services
  • Virtual consultations and coaching
  • Resource guides and educational materials

3. Important Disclaimers

3.1 Not Medical Professionals

We are birth and postpartum support professionals, NOT licensed medical providers. Our services are educational and supportive in nature. We do not:

  • Diagnose, treat, or cure any medical condition
  • Provide medical advice or clinical recommendations
  • Perform clinical assessments or medical procedures
  • Replace the care of physicians, midwives, nurses, or other licensed healthcare providers

You should always consult with qualified healthcare providers regarding any medical concerns about yourself, your pregnancy, or your child. In case of emergency, call 911 or go to the nearest emergency room immediately.

3.2 Not Mental Health Professionals

While we provide emotional support, we are not licensed therapists, counselors, or mental health professionals. If you are experiencing symptoms of perinatal mood disorders (postpartum depression, anxiety, etc.) or other mental health concerns, please seek support from a qualified mental health provider. We are happy to provide referrals to perinatal mental health specialists.

3.3 Sleep Consulting Disclaimer

Our infant sleep consulting services provide education and support based on current research and professional training. Every child is different, and we cannot guarantee specific outcomes. Sleep improvements depend on many factors, including consistency of implementation, your child's temperament, developmental stage, and medical factors. If you have concerns about your child's health affecting sleep (reflux, sleep apnea, etc.), please consult your pediatrician.

3.4 No Guaranteed Outcomes

While we are committed to providing exceptional support, we cannot guarantee specific birth outcomes, sleep results, or other particular results. Birth is unpredictable, and every family's journey is unique.

4. Client Responsibilities

To receive the best possible support, you agree to:

  • Provide accurate and complete information about your health, family, and situation
  • Communicate openly and honestly, including sharing any changes in your circumstances
  • Notify us promptly of any complications, hospitalizations, or changes to your care plan
  • Keep your healthcare providers informed of your decisions and seek their guidance for medical matters
  • Treat our team with respect and professionalism
  • Adhere to scheduled appointment times and provide adequate notice for cancellations
  • Make payments according to the agreed-upon schedule
  • For in-home services: ensure a safe and respectful environment for our team members

5. Booking, Payment, and Packages

5.1 Booking Process

Services are booked through a consultation process. Upon mutual agreement to work together, you will receive a service agreement outlining the specific scope, timeline, and investment for your package. A signed agreement and deposit are required to secure your spot.

5.2 Payment Terms

  • A non-refundable deposit is required to secure your booking (amount specified in your service agreement)
  • Remaining balance is due according to the payment schedule in your agreement
  • We accept major credit cards, debit cards, HSA/FSA cards (where applicable), and other payment methods as specified
  • Payment plans may be available for certain packages
  • All prices are in US dollars unless otherwise specified

5.3 Late Payments

If payment is not received by the due date, we reserve the right to pause services until the account is current. Accounts more than 30 days past due may be subject to a late fee and/or collection action.

6. Cancellation and Refund Policy

6.1 Consultations and Single Sessions

  • Free consultations may be rescheduled with at least 24 hours notice
  • Paid sessions require at least 48 hours notice for rescheduling
  • Sessions cancelled with less than 48 hours notice may be forfeited
  • No-shows (missed appointments without notice) will not be rescheduled

6.2 Birth Doula Services

  • Deposits are non-refundable as they reserve your estimated due date on our calendar
  • If you cancel more than 60 days before your due date, 50% of payments made (excluding deposit) may be refunded
  • Cancellations within 60 days of your due date are generally non-refundable, though we will work with you on a case-by-case basis
  • If you give birth before we are able to attend (precipitous labor), or if circumstances prevent our attendance despite best efforts, we will provide postpartum support of equivalent value where possible

6.3 Postpartum and Sleep Packages

  • Deposits are non-refundable
  • Unused hours or sessions may be forfeited if not used within the package timeframe
  • Refund requests for unused services will be considered on a case-by-case basis
  • Digital materials, sleep plans, and educational content delivered are non-refundable

6.4 Educational Programs

  • Self-paced online courses are non-refundable once access is granted
  • Group classes may be rescheduled to a future session with adequate notice
  • Private education sessions follow the same cancellation policy as single sessions

6.5 Cancellation by The Parenthood Project

In rare circumstances (illness, emergency, etc.), we may need to reschedule or arrange backup support. If we are unable to provide services as agreed and cannot offer a suitable alternative, you will receive a refund for services not rendered.

7. On-Call and Availability (Birth Services)

For birth doula clients:

  • We are on-call for your birth from 38 weeks gestation (or as specified in your agreement) until you give birth
  • You agree to contact us at the first signs of labor or when you think labor may be beginning
  • We will make every effort to attend your birth; however, in the rare event of scheduling conflicts (two clients in labor simultaneously), we maintain backup doula arrangements
  • We cannot guarantee arrival before birth in cases of very fast labor

8. Confidentiality

We treat your personal information and the details of our work together as confidential. We will not disclose information about you or your family to third parties without your consent, except:

  • When required by law
  • When necessary to coordinate care with your healthcare team (with your permission)
  • When there is concern for the safety of a child (see mandatory reporting obligations)
  • When working with backup support providers who agree to maintain confidentiality

9. Photography and Testimonials

We may request permission to use photos from our time together or your testimonial for marketing purposes. Any such use will be with your explicit, written consent, which you may decline or revoke at any time.

10. Intellectual Property

All content, materials, methods, curricula, sleep plans, and educational resources provided by The Parenthood Project USA are our intellectual property or used under license. You may use these materials for your personal, non-commercial use only. You may not:

  • Reproduce, distribute, or share our materials with others
  • Use our materials for commercial purposes
  • Modify or create derivative works from our materials
  • Remove any copyright or proprietary notices

11. Communication

By engaging our services, you consent to receive communications from us via email, text message, phone, and/or messaging apps regarding your services, appointments, and support. You may opt out of marketing communications at any time while still receiving service-related messages.

We will respond to non-urgent communications within 24-48 hours during business hours. For birth doula clients during the on-call period, we are available 24/7 for labor-related communications.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Parenthood Project USA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services
  • Our total liability for any claim arising from our services shall not exceed the total amount you paid for the specific service giving rise to the claim
  • We are not liable for outcomes outside our control, including birth outcomes, infant sleep patterns, or other results

13. Indemnification

You agree to indemnify, defend, and hold harmless The Parenthood Project USA, its owner, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any claim that your actions caused damage to a third party

14. Dispute Resolution

If a dispute arises from these Terms or our services, we encourage you to contact us first to attempt to resolve the matter informally. If we cannot resolve the dispute informally, you agree that:

  • Any dispute will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
  • Arbitration will take place in New York (or virtually, by agreement)
  • You waive your right to participate in class actions or class arbitrations

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with any service agreement you sign and our Privacy Policy, constitute the entire agreement between you and The Parenthood Project USA regarding your use of our services. Any individual service agreement you sign may contain additional terms specific to that service, which will supplement these general Terms.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. We will update the "Last Updated" date at the top of these Terms. Your continued use of our services after any changes indicates your acceptance of the modified Terms.

For active clients with signed service agreements, the Terms in effect at the time of signing will generally apply to that engagement.
